Assumption of Risk:

I, the minor's parent or legal guardian, understand the nature of the activities I and/or my child will be involved in at Maricopa Dance and Fitness.  I know my and/or the minor's experience and capabilities, and believe I and/or the minor to be qualified, in good health, and in proper physical condition to participate in such activities.

 I understand that dancing and engaging in acrobatic activities are inherently dangerous activities in which I and/or the minor voluntarily choose to participate at our own risk.  I acknowledge that there is a risk that our child may suffer minor and/or serious injuries as the result of these activities.

I understand that the dangers to which I and/or the minor may be exposed include, but are not limited to the child’s own acts, the acts of other students, competitors, dancers and/or teachers, the condition of the floor or stage, the acts or spectators, the condition of equipment, acts of others on the premises such as owners and members of the media and weather.

I and/or the minor knowingly and freely assume all such risks, both known and unknown, and voluntarily participate at our own risk and assume sole responsibility for any injury, death or property damage we may suffer that arises from our child’s participation in activities at or sponsored by Maricopa Dance.

     
 

Release of Liability:

For myself, the minor, heirs, successors, representatives and assigns I hereby KNOWINGLY AND INTENTIONALLY WAIVE ALL CLAIMS AGAINST AND RELEASE MARICOPA DANCE & FITNESS including any and all liability claims for my and/or the minor's injuries, death, losses, or damage to any property. We also release Maricopa Dance & Fitness owners, employees, other students, former and successor affiliated corporations and entities, limited liability companies, other representatives and related entitities.

I understand that rescue efforts may not be effective and that we waive any and all claims against Maricopa Dance &Fitness arising out of rescue efforts or the failure to engage in rescue efforts.

In addition, each of us hereby agree that if, despite this relesae, I, the minor, or anyone on the minor's behalf makes a claim against Maricopa Dance & Fitness, we indemnify, save, and hold harmless Maricopa Dance & Fitness from any litigation expenses, attorney fees, loss liability, damage, or any cost that may occur as the result of any such claim. 

I intend this release to be very broad, including any and all claims I and/or the minor may have, known or unknown against Maricopa Dance & Fitness.

This contract is severable; that is, if any part of it is held by an arbitration panel or court of law to be unenforceable, the rest of it will remain in effect.

     
 

Payment Policies & Methods

I understand that:

  • Tuition is due on the 25th for the following month.
  • Accounts paid after the 1st of the month will incur a $15.00 late fee
  • Tuition is NOT refundable.
  • Tuiton for the first and last month must be paid at the time of enrollment
  • The registration fee ($35.00) is to be paid at the time of enrollment
  • The costume fee ($80.00) for each class is to be paid on October 15th & March 15th.
  • The stage fee ($45.00) for each class is to be paid on May 1st.

 

 The following payment methods are available (subject to change):

      • You may use the envelopes available at the studio to make your payments. You may slide your payment envelopes under the door if the office is closed.  Please indicate name and what payment is for so we can apply your payment properly.

Medical Emergencies:

In any event of an accident or emergency I hereby authorize my child to be transported to a hospital for medical treatment and I hold Maricopa Dance and Fitness and it's representatives harmless in the execution of such. Additionally, I hereby agree to individually provide for all medical expenses which may be incurred by me or my child(ren) as a result of any injury sustained while participating at or for Maricopa Dance and Fitness.

     
 

Studio Policies:

Please review and agree to our studio policies:

  1. MD&F follows MUSD’s calendar.  No classes take place during the district’s breaks and on district holidays.
  2. Make-up classes are offered for classes missed due to school holidays and school breaks and other excused absences (i.e. sickness).  Classes have to be made up within 30 days.
  3. I realize that dance is a group effort.  I agree to bring my child/ren to class consistently and on time and will contact the studio if my child will be absent. Irregular attendance affects the choreography and learning of every student and may result in not being allowed to participate in recitals.
  4. Recitals are scheduled in December and June.  Dress rehearsal typically is held one day prior.  Picture day is usually held one weeks before the recital.  Picture Day is optional.  Rehearsal is not.
  5. Once you agree to participate in the recital a production fee deposit ($20.00) and a costume deposit ($25 per costume) are due.  Tights and accessories are not included in the costume cost. There are no refunds on any recital related fees.
  6. Costume alterations are not the responsibility of MD&F.  MD&F follows guidelines set by the costume companies and adds 2” to each measurement to allow for growth prior to recital day.
  7. I agree to contact my child’s dance teacher regarding questions/concerns pertaining to my child’s class.
  8. Office hours are posted in the studio window.  You may contact us by phone or e-mail if no one is in the office.
  9. Phone calls will be returned within 48 hours.  E-mails typically result in faster response time.
  10. All students are required to be covered under their own family insurance. If injury occurs student’s own policy is the only source of reimbursement.
  11. I will inform MD&F of any changes in contact information, including e-mail.  I realize that MD&F’s primary way to communicate is via e-mail notification and newsletters and agree to read all MD&F information sent to me via e-mail.
  12. 30 days written notice is required to drop a class or your will be charged for that month. The associated forms are available at the front of the studio.
  13. Parking lot- DO NOT EVER LET YOUR CHILD PLAY IN THE PARKING LOT. We often see parents chatting in the lobby after class while their child walks out the door without them. We also see parents chatting outside the studio while their child plays between cars or in the neighboring business parking. This is absolutely against studio policy. Children are not to be left outside without supervision or leave the building without an adult.
  14. Send your student(s) to the studio prepared for class- Have the student(s) dressed in the necessary equipment
  15. Viewing windows- The viewing window gives you an opportunity to watch class every so often and see the student's progress. Please feel free to watch class. If you notice students paying more attention to you than the instructor, please move away from the window. You might be a distraction to other students in the class, or possibly the teacher. Do not allow siblings to stand in lobby chairs while watching through the viewing window. Please make sure siblings are not distracting class.
  16. The lobby- Families are always welcome in the lobby but please keep in mind that lobby space is limited and it gets really hot in the waiting area. If you utilize the lobby, please throw trash away and straighten toys before leaving. Please replace chairs if you move them.
  17. Before and after class- Most classes start as a class ends. Please gather your child and be prepared to leave the building after class is over. Please be courteous to the class that comes after your class is over.
  18. Communication- The best way to communicate with teachers is by emailing through email or calling the studio. Phone messages may not be returned the same day. Teachers cannot accept calls during class time.
     
 

Media Release:

I understand that from time to time, media (including photographs and videos) may be taken of myself and/or the minor while engaging in and/or observing Maricopa Dance & Fitness activities.  I and/or the minor consent to allow Maricopa Dance & Fitness gratuitous use of this media containing my and/or the minors likeness for its business purposes including, without limitation, publication on its website, posting in its business premises and/or use in advertising.
